Terms of Service

1. Introduction

Welcome to Trot Up Photography. These Terms of Service (“Terms”) govern your use of our photography services. By engaging our services, you agree to abide by these Terms. If you do not agree with these Terms, please do not use our services.

2. Services Provided

We offer photography services including but not limited to portrait sessions, event coverage, and product photography. Specific details of the services, including the scope, location, and duration, will be outlined in a separate Service Agreement.

3. Booking and Payment

Booking: To book our services, you must complete the booking process, which may include signing a Service Agreement and paying a deposit. The deposit amount and payment terms will be specified in the Service Agreement.
Payment: Full payment for services is due as outlined in the Service Agreement. Accepted payment methods include bank transferral & PayPal (in some cases). Late payments may incur additional fees.

4. Cancellation and Rescheduling

Client Cancellation: If you cancel the booking more than 7 days before the scheduled session, you may receive a refund of the deposit minus any non-refundable fees. Cancellations made within 2 days of the session may result in forfeiture of the deposit.
Rescheduling: If you need to reschedule, please provide at least 2 days’ notice. Rescheduling is subject to availability, and any additional costs will be communicated to you in advance.

5. Delivery and Ownership

Delivery: Deliverables, including digital files and prints, will be provided as specified in the Service Agreement. We aim to deliver your final images within 1-3 weeks of the session. Delivery timelines may vary based on the scope of work and other factors.
Ownership: Copyright of all images remains with Trot Up Photography. You will receive a license to use the images for personal purposes as outlined in the Service Agreement. Commercial use of the images requires separate licensing.

6. Usage Rights

Client Use: You may use the images for personal purposes, including printing and sharing on social media. Any commercial use requires prior written consent from Trot Up Photography.
Photographer’s Use: We reserve the right to use the images for promotional purposes, including on our website, social media, and portfolio. If you do not wish for your images to be used, please inform us in writing prior to the session.

7. Client Responsibilities

Cooperation: You agree to cooperate with us by providing necessary information, being punctual, and adhering to agreed-upon schedules and locations.
Location and Permits: You are responsible for securing any necessary permits or permissions required for shooting at a specific location.

8. Limitation of Liability

Limitation: Our liability for any claim arising from our services is limited to the amount paid for the specific services in question. We are not liable for any indirect, incidental, or consequential damages.
Force Majeure: We are not responsible for delays or failures in performance due to circumstances beyond our control, including but not limited to natural disasters, accidents, or other unforeseen events.

9. Confidentiality

We will maintain the confidentiality of your personal information in accordance with our Privacy Policy. Your information will not be shared with third parties except as necessary to provide the services or as required by law.

10. Termination

We reserve the right to terminate the service agreement if you breach these Terms or fail to comply with the terms outlined in the Service Agreement. In the event of termination, you will be liable for any outstanding fees or costs incurred up to the point of termination.

11. Dispute Resolution

Any disputes arising from these Terms or the Service Agreement will be resolved through legal proceedings.

12. Amendments

We may update these Terms from time to time. Any changes will be posted on our website or communicated to you via email. Continued use of our services constitutes acceptance of any modifications.
